A 35-year-old woman was on a first date at her Upper East Side apartment when she stepped outside for a cigarette. Her date followed her onto the balcony and was horrified when the railing she was perched on suddenly gave way, bending into a “v”. The woman tumbled backward and fell 17 floors to her death.
New York City building officials removed the broken railing and will examine it to determine why it failed. The NYC Buildings Department ordered residents of the Manhattan building to stay off their balconies, pending the investigation.
This fatal apartment building accident serves as a reminder that seemingly safe structures can fail when they are negligently maintained or defectively manufactured. Don’t place too much trust in the conditions around you, even when they appear sound.
If you or a loved one has been seriously injured or killed because of a defective condition in a NYC building, an experienced premises liability attorney can help you explore your legal options.
