Now that the action has been started the summons and complaint has to be SERVED upon the defendant in the manner called for in the statutes. The objective is to personally serve the defendant. There are numerous statutes which govern the manner in which the Summons and Complaint can be served to accomplish this. What is important is that the Plaintiff cannot serve the documents himself. Our office relies on licenced professional process servers to accomplish this task. It is not as easy as one imagines. In many situations defendants will attempt to evade service in an effort to avoid the ultimate consequences of being held responsible for their mistake. The statutes take this into account and provide several alternate measures to accomplish the goal.
