New York Civil Lawsuit-Note of Issue

Once all of the discovery has been completed. All of the medical reports, witnesses and photos have been exchanged it is time to put your case on the trial calendar. This requires the filing [and payment of an additional filing fee of $95.00] of a Note of Issue which is the attorney's certification that all preliminary work on the case has been concluded and that the case is trial ready. The clerk then issues a calendar number, and the wait begins. The calendar number is similar to the number that you may get at the deli counter of the supermarket. You get on line and wait your turn to be called to the courthouse. The delay in getting to the front of the line is dependent on the congestion of the particular court's calendar. It can be from 6 to 18 months.
